• राजस्थान किराया नियंत्रण अधिनियम, धारा 9(i) बेदखली का आदेश वास्तविक आवश्यकता किरायेदार द्वारा रिट याचिका याचिकाकर्ता ने इस तथ्य से इनकार नहीं किया है कि प्रतिवादी/मकान मालिक एक विधवा महिला है जिसके तीन बच्चे हैं, जिनमें से एक लड़की अविवाहित है और उसका पालन-पोषण कर रही है अध्ययन – इसके अलावा, प्रतिवादी ने निष्कासन याचिका दायर करके विशेष रूप से मामला बनाया कि उसके पति की मृत्यु के कारण, प्रतिवादी के पास आजीविका का कोई अन्य स्रोत नहीं है और वह खुद के साथ-साथ अपने बच्चों का भरण-पोषण करने के लिए वित्तीय कठिनाई का सामना कर रही है – इस प्रकार, वह इस आधार पर बेदखली याचिका दायर की है कि विवाद में परिसर को अपने और अपनी अविवाहित बेटी के भरण-पोषण के लिए कृत्रिम आभूषणों का व्यवसाय चलाने के लिए वास्तविक आवश्यकता के कारण आवश्यक है – प्रतिवादी, जो एक विधवा महिला है, जिसकी अविवाहित बेटी है, व्यवसाय खोलने का इरादा रखती है। कृत्रिम आभूषण अपना व्यवसाय शुरू करने का स्थान तय करने के लिए सबसे उपयुक्त व्यक्ति हैं और व्यवसाय चलाने के लिए उपयुक्त स्थान तय करने का निर्णय उनके अलावा कोई नहीं ले सकता है। [पैरा 19 और 21]
