↗️📌SPECIFIC RELIEF ACT, 1963-Section 34 proviso suit for declaration-Maintainability-Court is barred from making declaration if plaintiff omits to seek further relief-Plaintiff not seeking relief of possession though had suffered a decree in earlier suit to the effect that he was not in possession of suit property Plaintiff also prohibited under Order 2. Rule 2(3) from seeking any relief on same cause of action-Trial Court decreeing suit and Appellate Court confirming it-Not sustainable in law-Decree set aside Suit dismissed.
Appeal allowed.
