ESAKKIMUTHU Vs STATE REPRESENTED BY THE INSPECTOR OF POLICE

Title :- SC Acquits Accused in TASMAC Murder Case Due to Eyewitness Doubts

The Supreme Court acquitted two accused, Esakkimuthu and Pitchu Mani, who were convicted of murdering a man at a TASMAC shop. The trial and High Courts relied heavily on eyewitnesses PW-1 and PW-2, the deceased’s son and wife. The Apex Court found it improbable they could have cycled 16 km in 30 minutes to witness the murder. The Court noted inconsistencies, the absence of credible independent witnesses, and doubts about the accused’s presence at the scene. As the prosecution failed to prove guilt beyond reasonable doubt, both were acquitted and ordered to be released.
