When application under order 9 rule 13 is rejected appeal against ex parte decree can be fied with an application under section 5 of the Limitation Act.

An appeal under Section 96(2) CPC is permissible against an ex parte decree even after a petition under Order 9 Rule 13 CPC is dismissed.
This fact is not in dispute and has been upheld in the judgments cited above.
Time spent in proceedings to set aside the ex parte decree, including the appeal and SLP, constitutes sufficient cause under Section 5 of the Limitation Act to justify condoning the delay in filing the first appeal.
