Motor Accident Claim Quantum The appellant challenges the award of compensation to the respondents, who are the family members of a deceased victim of a road accident, on the grounds of excessive quantum and incorrect application of future prospects and conventional heads – The Court modifies the income of the deceased from Rs. 8,000 to Rs.7,000 per month, based on some guesswork and the judgments of the Supreme Court in similar cases, where the income was assessed without documentary evidence – Future prospects and conventional heads revised – The Court also reduces the future prospects from 50% to 40%, as per the law laid down by the Supreme Court in Pranay Sethi’s case, and increases the amount awarded under the conventional heads of loss of estate, funeral expenses and loss of consortium, as per the law laid down by the Supreme Court in Magma General Insurance Company Limited’s case and N. Jayasree’s case – The Court disposes of the appeal and modifies the award passed by the Tribunal, granting the respondents a total compensation of Rs. 12,38,400 with interest @ 6% per annum from the date of filing of the claim petition
