• मुख्य न्यायाधीश द्वारा अधिसूचित धारा 438 सीआरपीसी पीएमएलए अधिनियम रोस्टर एक खाली औपचारिकता नहीं है, एक पीठ के समक्ष लंबित रिट को दूसरी पीठ में स्थानांतरित कर दिया गया है। मामले को जारी करने के बाद, जब जमानत देने के लिए प्रतिवादी द्वारा कोई प्रार्थना भी नहीं की गई थी, तो पीठ ने जमानत दे दी। पहले प्रतिवादी को रिहा करने के लिए जमानत रिट याचिका के लंबित रहने के दौरान भी, प्रतिवादी को जमानत नहीं दी गई थी, हालांकि याचिका में जमानत देने की अंतरिम राहत के लिए प्रार्थना की गई थी, जिसमें कहा गया था कि बेंच जमानत के लिए प्रार्थना नहीं सुन सकती थी। रोस्टर बेंच उसी दिन सुनवाई कर सकती थी, उस दिन, पहले प्रतिवादी के वकील ने स्वीकार किया कि उसने जमानत के लिए आवेदन किया था, अपीलकर्ताओं की जमानत की प्रार्थना पर सुनवाई नहीं हुई थी, इसके अलावा, पीएमएलए के तहत एक अपराध में बिना कोई कारण दर्ज किए जमानत दे दी गई थी – जमानत नहीं दी जा सकती ऐसे मामले में केवल “संतुलन कायम करने” के लिए अनुमति दी जाती है। [पैरा 7]
