• Order 9 Rule 13 Setting aside of ex-Parte decree Judicial order Counsel for the petitioners has submitted that the well reasoned order passed by the trial court, dismissing the application filed by the defendants/respondents for setting aside the exparte proceedings against them, has been wrongly reversed and the appeal filed by the defendants/respondents has wrongly been allowed, without properly appreciating the evidence on file. It is further submitted that the defendants/respondents were duly served before being proceeded ex-parte. They had refused to accept the summons. On report to that effect only, the trial court had proceeded ex-parte against the respondents. Still further, it is submitted that respondents have not even pleaded as to how they came to know of the factum that they were proceeded ex-parte and that the judgment and decree have been passed against them. Still further, it is submitted that once the judicial order has come on the file to the effect that the defendants were duly served, then the said order has to be taken as rightly passed

• आदेश 9 नियम 13 एकपक्षीय डिक्री न्यायिक आदेश को रद्द करते हुए याचिकाकर्ताओं के वकील ने प्रस्तुत किया है कि ट्रायल कोर्ट द्वारा पारित तर्कसंगत आदेश, प्रतिवादियों/प्रतिवादियों द्वारा उनके खिलाफ एकपक्षीय कार्यवाही को रद्द करने के लिए दायर आवेदन को खारिज कर दिया गया है। , को गलत तरीके से उलट दिया गया है और प्रतिवादियों/प्रतिवादियों द्वारा दायर अपील को फाइल पर मौजूद साक्ष्यों की उचित सराहना किए बिना गलत तरीके से अनुमति दी गई है। आगे यह प्रस्तुत किया गया है कि प्रतिवादियों/प्रतिवादियों को एकपक्षीय कार्यवाही करने से पहले विधिवत सेवा दी गई थी। उन्होंने समन स्वीकार करने से इनकार कर दिया था. केवल इस आशय की रिपोर्ट पर, ट्रायल कोर्ट ने उत्तरदाताओं के खिलाफ एकपक्षीय कार्यवाही की थी। फिर भी, यह प्रस्तुत किया गया है कि उत्तरदाताओं ने यह भी अनुरोध नहीं किया है कि उन्हें इस तथ्य के बारे में कैसे पता चला कि उन पर एकतरफा कार्रवाई की गई थी और उनके खिलाफ निर्णय और डिक्री पारित की गई है। इसके अलावा, यह प्रस्तुत किया गया है कि एक बार न्यायिक आदेश इस आशय की फ़ाइल पर आ गया है कि प्रतिवादियों को विधिवत तामील कर दी गई है, तो उक्त आदेश को उचित रूप से पारित माना जाना चाहिए
