• Order 7 Rule 11 CPC Rejection of plaint Dispute pending before this Court is not between the same parties and the pendency of the said case would not bar the instant suit. Further, it has been held that an earlier suit between the same parties was withdrawn before the Lok Adalat and there was no final decision. The order would not act as res judicata as there was no final decision on merits. Suit being an injunction suit, can be filed as and when the cause of action arises. It is not the case of the petitioners that the plaint does not disclose a cause of action. Consequently, application under Order 7, Rule 11 C.P.C has been dismissed

• आदेश 7 नियम 11 सीपीसी वादी की अस्वीकृति इस न्यायालय के समक्ष लंबित विवाद समान पक्षों के बीच नहीं है और उक्त मामले के लंबित रहने से तत्काल वाद पर रोक नहीं लगेगी। इसके अलावा, यह माना गया है कि समान पक्षों के बीच पहले का मुकदमा लोक अदालत से पहले वापस ले लिया गया था और कोई अंतिम निर्णय नहीं हुआ था। यह आदेश पूर्व न्यायिक के रूप में कार्य नहीं करेगा क्योंकि इसमें गुण-दोष के आधार पर कोई अंतिम निर्णय नहीं लिया गया था। मुकदमा एक निषेधाज्ञा मुकदमा है, जिसे कार्रवाई का कारण उत्पन्न होने पर दायर किया जा सकता है। याचिकाकर्ताओं का मामला यह नहीं है कि वादी कार्रवाई के कारण का खुलासा नहीं करता है। नतीजतन, आदेश 7, नियम 11 सी.पी.सी. के तहत आवेदन खारिज कर दिया गया है
