Power to dismiss an employee cannot be delegated .

A minority school cannot delegate the statutory powers of the “Manager” to any other person for dismissing a teacher.

The Court found that the termination order was passed by an unauthorized person and therefore set aside the dismissal.

However, the Court upheld the validity of the departmental inquiry conducted against the teacher.

The teacher was accused of misbehaviour and instigating students.

The Court directed the school to initiate fresh proceedings from the stage of issuing the second show-cause notice.

Accordingly, the matter was remitted back for reconsideration in accordance with law. –
