Supreme Court clips Waqf Act’s wings, stays key land clause.
The Supreme Court refused to grant an interim stay on the entire Waqf (Amendment) Act, 2025, but found a specific provision (the proviso to Section 3C(2)) to be “prima facie arbitrary” and “not sustainable in law” as it treats a property as non-waqf before an inquiry can be conducted. The Court also held that a provision allowing a revenue officer to determine a property’s title would not be in tune with the principle of separation of powers.
