Weekly Judgments (8th September 2025 – 12th September 2025)

📌 Pradeep Kumar Kesarwani v. State of Uttar Pradesh, 2025 SC
The Supreme Court held that consensual sex on a genuine promise of marriage cannot be treated as rape. It becomes rape only if the promise was false and mala fide from the beginning. A mere breach of promise does not amount to deception under Section 375 IPC.

📌 Rakesh Dutt Sharma v. State of Uttarakhand, 2025 SC
The Court ruled that the right of private defence cannot be weighed in “golden scales.” A person acting in self-defence is not expected to measure force with precision. The law must take a practical view of the situation.

📌 Ramesh Chand v. Suresh Chand, 2025 SC
It was held that under Section 68 of the Indian Evidence Act (now Section 67 of BSA, 2023), a Will must be proved by examining at least one attesting witness. This safeguard is mandatory and cannot be waived even if no heir contests the Will.

📌 Jupally Lakshmikantha Reddy v. State of Andhra Pradesh, 2025 SC
The Supreme Court clarified that submitting a forged document does not amount to cheating under Section 420 IPC unless it actually induces wrongful gain or causes loss. Forgery and cheating are distinct offences.

📌 Kailash Ramchandani v. State of Maharashtra, 2025 SC
The Supreme Court emphasized that trials in heinous offences must be time-bound. Delay in such trials is often misused by accused persons to secure bail or weaken the case. Speedy trial is part of Article 21.

📌 Pradnya Pranjal Kulkarni v. State of Maharashtra, 2025 SC
The Supreme Court held that FIR/charge-sheet can be quashed under Article 226 only before cognizance is taken. After cognizance, the remedy lies under Section 528 BNSS. This ensures clarity in criminal procedure.

📌 Malleeswari v. K. Suguna, 2025 SC
The Supreme Court explained that review jurisdiction is very limited. Review cannot be treated as an appeal and is only meant to correct errors apparent on the face of the record.

📌 H.S. Oberoi Buildtech Pvt. Ltd. v. MSN Woodtech, 2025 SC
The Supreme Court held that a cheque bounce complaint under Section 138 NI Act must be filed within 30 days as per Section 142(b). Delay can be condoned only with a proper application showing valid reasons.

📌 Union of India v. Sajib Roy, 2025 SC
The Supreme Court ruled that reserved category candidates who avail age relaxation benefits cannot later claim seats in the general category if rules prohibit such migration. This ensures fairness in recruitment.

📌 Golapi Majhi v. Bhabanishankar Budulal, 2025 Orissa HC
The HC refused to allow a DNA test in a partition suit, holding that it was unnecessary for deciding property rights and would violate the right to privacy under Article 21.

📌 Khelo Ram v. State of Himachal Pradesh, 2025 Himachal Pradesh HC
The HC upheld convictions under Sections 452, 354, and 323 IPC but set aside conviction under Section 324 IPC, holding that human teeth cannot be considered a deadly weapon.
