📌 Anil Kumar v. State of Jharkhand, 2025 SC
The Supreme Court observed that bail conditions not traceable to statutory provisions can generate further litigation while setting aside the Jharkhand High Court’s decision to impose a pre-arrest bail condition requiring the accused husband to resume conjugal rights with his wife and maintain her with dignity and honour.
📌 Jamnalal v. State of Rajasthan, 2025 SC
The Supreme Court held that bail under Section 389 of the Criminal Procedure Code, 1973 (CrPC) can’t be granted unless there is prima facie material indicating a fair chance of acquittal.
📌 X v. Y, 2025 Delhi HC
Delhi High Court held that technical delays or procedural lapses cannot defeat the purpose of interim maintenance under Section 125 the Code of Criminal Procedure, 1973 (CrPC).
📌 Bhanei Prasad @ Raju v. State of Himachal Pradesh, 2025 SC
The Supreme Court reaffirms that incestuous sexual violence cannot be condoned under any circumstances as it fundamentally undermines the foundation of familial trust.
📌 Rakesh Kumar Chaturvedi v. State of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lucknow, 2025 Allahbad HC
The Allahabad High Court held that a Magistrate cannot issue notice under Section 223 of Bharatiya Nagarik Suraksha Sanhita,2023 (BNSS) without first recording the sworn statements of the complainant and witnesses and quashed the improperly issued notice.
📌 Narayan Yadav v. State of Chhattisgarh, 2025 SC
“A confessional FIR made by an accused person is inadmissible in evidence against him, except to show he made a statement soon after the offence, identifying him as the maker of the report under Section 8 of the Evidence Act.”
📌 Manni Devi v. Rama Devi, 2025 Rajasthan HC
The Rajasthan High Court held that denying daughters of Scheduled Tribe communities equal rights in ancestral property is unjustified and urged the Central Government to amend Section 2(2) of the Hindu Succession Act,1956 to ensure gender equality among tribals.
📌 Delhi Pollution Control Committee v. Lodhi Property Co. Ltd, 2025 SC
The Supreme Court upheld that Pollution Control Boards are empowered to impose environmental compensation under Sections 33A of the Water Act and 31A of the Air Act for actual or imminent environmental harm.
📌 Ram Kishan v. Ram Dai, 2025 Rajasthan HC
The Rajasthan High Court held that service of summons under Order V Rule 17 Code of Civil Procedure, 1908 (CPC) without a verifying witness’s signature is invalid.
📌 Wakia Afrin (Minor) v. M/S National Insurance Co. Ltd, 2025 SC
The Supreme Court have referred to a larger bench the question of whether legal heirs of vehicle owners who die in self-accidents can claim compensation under Section 163A of the Motor Vehicles Act (MVA) due to conflicting precedents.
📌 Vinu C. Kunjappan v. State of Kerala, 2025 Kerala HC
The Court held that unintentional failure to lower the National Flag after sunset does not constitute an offence under the Prevention of Insults to National Honour Act, 1971, in the absence of deliberate intent or mens rea.
📌 In Re: T.N. Godavarman Thirumulpad v. Union of India, 2025 SC
“Permitting the practice of hand-pulled carts/ rickshaws, which is against the basic concept of human dignity in a country like India, which is a developing country, belittles the constitutional promises of social and economic justice.”
📌 Prabodh Kumar Tiwary v. Rakesh Kumar Tiwary, 2025 Jharkhand HC
The Court held that amendment of pleadings at the appellate stage cannot be allowed without strong justification for delay or compliance with earlier permitted amendments during trial.
