Supreme Court Questions Validity of Power of Attorney Holder’s Authority in Property Deals
The Supreme Court disagreed with its earlier ruling in Rajni Tandon vs. Dulal Ranjan Ghosh Dastidar, holding that a power-of-attorney holder executing a sale deed remains an agent of the principal and must comply with authentication requirements under the Registration Act, 1908. The matter was referred to a larger Bench for conclusive settlement.
