Supreme Court Grants permission to Adv Charanjeet Singh Chanderpal to make representation to Ministry of Law to change the law to grant Advertisment permission and Alternate Parallel vocation permission for lawyers and records that BCI will not oppose it – PIL filed by Adv Charanjeet Singh Chanderpal President Nitya Law Society- Wp 627 Of 2020 vs BCI, BCMG and BCD…Order passed today at Serial no 6 by Justice Bhushan Gavai and Justice Augustine Masih at the Honorable Supreme Court :
The line of arguments was as hereunder:
- Foreign Firms are now allowed to operate, law has changed.
- In all Developed countries, advertisement by lawyers is permitted.
- The Chartered Accountants though not permitted set up various consultancies and advertise and give competition to lawyers.
- The unqualified and unorganised sector like consultants , etc give advertisements for GST, StamP Duty, Registration and various works. They offer competition to lawyers.
- Huge Sized Law firms are operating with international consultancies and are having the beneft of international and national advertisements .
- Almost all lawyers are registered on Just Dial even BCI and Bcmg Members
- many even have web sites.
And what about the indigenuous individual lawyer , may be the sole earner in his family. In Covid 19 times, this problem was noted seriously.
Therefore, Rule 47 to 50 oF BCI rules would have to be amended. These laws are all outdated.
The Bench asked BCI counsel Radhika Gautam, if there was any opposition and BCI stated there is no opposition,
