IMPORTANT JUDGEMENT
Family Courts Act Section 19 – Hindu Marriage Act, Section 13(1)(ia) – Petition for divorce on ground of cruelty – Petition dismissed by Family Court – Appeal against same – Appellant has not been able to prove any of his allegations made against the respondent – He has made vague and general allegations regarding threats to commit suicide and implication in criminal cases – It is the respondent who has been subjected to cruelty and not the appellant – Family Court, has given cogent reasons while dismissing the Divorce Petition, which does not merit any interference – Present appeal accordingly dismissed. पारिवारिक न्यायालय अधिनियम धारा 19 – हिंदू विवाह अधिनियम, धारा 13(1)(ia) – क्रूरता के आधार पर तलाक के लिए याचिका – पारिवारिक न्यायालय द्वारा याचिका खारिज – उसी के खिलाफ अपील – अपीलकर्ता प्रतिवादी के खिलाफ लगाए गए अपने किसी भी आरोप को साबित नहीं कर पाया है – उसने आत्महत्या करने की धमकी और आपराधिक मामलों में फंसाने के बारे में अस्पष्ट और सामान्य आरोप लगाए हैं – यह प्रतिवादी है जो क्रूरता का शिकार हुआ है, न कि अपीलकर्ता – पारिवारिक न्यायालय ने तलाक याचिका को खारिज करते समय ठोस कारण दिए हैं, जो किसी भी हस्तक्षेप के योग्य नहीं हैं – तदनुसार वर्तमान अपील खारिज की जाती है। [पैरा 41 से 43]
