• NDPS ACT Sections 21, 22 and 59(2)(b) Menace of drugs Death in Drug De-addiction Centre Compensation for Death Abuse of drugs is adversely impacting the progressive and dynamic character of a large population of the State Deceased committed suicide due to insensitivity of the attendants Deceased had been jailed for 5 years for abetment of suicide of his girlfriend and he was addicted to drugs Deceased was stated to be only 35 years old and the father was admittedly working as electrician in the Old Dana Mandi at Kapurthala and it is apparent that on account of the addiction his son was suffering Responsibility has to be shared by the State on account of the fact that the petitioner has lost his son though it was his hope that the de-addiction centre would cure him – Sufficient care should have been extended towards him and an extra watch should have been kept so that he would not have been successful in his attempts – Compensation granted. • एनडीपीएस अधिनियम की धारा 21, 22 और 59(2)(बी) नशीली दवाओं का खतरा, नशा मुक्ति केंद्र में मृत्यु, मृत्यु के लिए मुआवजा, नशीली दवाओं का दुरुपयोग राज्य की एक बड़ी आबादी के प्रगतिशील और गतिशील चरित्र पर प्रतिकूल प्रभाव डाल रहा है। परिचारकों की असंवेदनशीलता के कारण आत्महत्या मृतक को अपनी प्रेमिका को आत्महत्या के लिए उकसाने के आरोप में 5 साल की जेल हुई थी और वह नशे का आदी था। मृतक की उम्र केवल 35 वर्ष बताई गई है और पिता पुरानी दाना मंडी में इलेक्ट्रीशियन के रूप में काम करते थे। कपूरथला और यह स्पष्ट है कि नशे की लत के कारण उसका बेटा पीड़ित था, इस तथ्य के कारण राज्य द्वारा जिम्मेदारी साझा की जानी चाहिए कि याचिकाकर्ता ने अपने बेटे को खो दिया है, हालांकि उसे उम्मीद थी कि नशा मुक्ति केंद्र उसे ठीक कर देगा – उसकी पर्याप्त देखभाल की जानी चाहिए थी और अतिरिक्त निगरानी रखी जानी चाहिए थी ताकि वह अपने प्रयासों में सफल न हो सके – मुआवजा दिया गया। [पैरा 68 और 69]
