• Order 41, Rule 27 CPC Permission to lead additional evidence Dismissal of suit for declaration claiming ownership On the ground that the old and new khasra numbers of the suit land could not be linked by the plaintiffs as reflected in jamabandi for the years 1950-1951 as compared to khasra numbers reflected in jamabandi for the year 2002-2003 – Plaintiff-appellant was non suited due to improper identification of property – In appeal, appellant had filed an application to prove revenue documents namely Khatuni Istemal, Naksha Haqdawar and Khatauni Paimaish so as to connect old Khasra numbers with new khasra numbers pertaining to the land in dispute – No order was passed on said application and appeal was decided against the appellant – Matter remanded back to first appellate court. • आदेश 41, नियम 27 सीपीसी अतिरिक्त सबूत पेश करने की अनुमति स्वामित्व का दावा करने वाली घोषणा के लिए मुकदमे को खारिज करना इस आधार पर कि वाद भूमि के पुराने और नए खसरा नंबरों को वादी द्वारा जोड़ा नहीं जा सका जैसा कि वर्ष 1950 की जमाबंदी में दर्शाया गया है। -वर्ष 2002-2003 की जमाबंदी में दर्शाए गए खसरा नंबरों की तुलना में 1951 – संपत्ति की अनुचित पहचान के कारण वादी-अपीलकर्ता उपयुक्त नहीं था – अपील में, अपीलकर्ता ने खतौनी इस्तेमाल, नक्शा हकदावर और खतौनी जैसे राजस्व दस्तावेजों को साबित करने के लिए एक आवेदन दायर किया था पैमाइश ताकि विवाद में भूमि से संबंधित पुराने खसरा नंबरों को नए खसरा नंबरों से जोड़ा जा सके – उक्त आवेदन पर कोई आदेश पारित नहीं किया गया और अपीलकर्ता के खिलाफ अपील का फैसला किया गया – मामला प्रथम अपीलीय अदालत में वापस भेज दिया गया। [पैरा 7, 9, 10 और 11]
