• आदेश 16, नियम 1 सीपीसी उन गवाहों को बुलाना जिनका नाम गवाहों की सूची में नहीं है, प्रतिवादी/वादी यह साबित करना चाहते हैं कि विचाराधीन लेनदेन बिक्री का है। यह प्रतिवादी/वादी का मामला है कि इमारत के डेवलपर्स ( दो अतिरिक्त गवाहों की जांच की मांग की गई है) समझौते के पक्षकारों की पुष्टि कर रहे हैं जिन्हें निष्पादित किया जाना चाहिए था, समन को इस आधार पर अस्वीकार नहीं किया जा सकता है कि इस तरह की चूक का कारण नहीं बताया गया है जब पार्टियों के बीच विवाद के वास्तविक प्रश्न को निर्धारित करने के लिए उनकी परीक्षा आवश्यक प्रतीत होती है। [पैरा 9, 10, 12 और 13]
