• धारा 227 सीआरपीसी डिस्चार्ज चैलेंज आरोप है कि महिला आरोपी व्यक्तियों ने अन्य पुरुष आरोपी व्यक्तियों को शिकायतकर्ता पर हमला करने के लिए उकसाया। आरोपी व्यक्तियों को महिला होने के नाते इस आधार पर बरी कर दिया गया कि पुरुष आरोपी व्यक्तियों को उकसाने का कोई सबूत नहीं था क्योंकि पुरुष आरोपी व्यक्ति पहले से ही अलग-अलग हथियारों से लैस थे। हालांकि, शिकायतकर्ता ने विशेष रूप से कहा कि जब पुरुष आरोपी व्यक्ति उसे पीट रहे थे, तो महिला सह-आरोपी भी उनके साथ शामिल हो गईं और मारने के लिए उकसाया। इसके अलावा, ट्रायल कोर्ट ने ऐसा कोई कारण नहीं बताया जिससे यह विश्वास हो कि ‘महिला सदस्य’ इस घटना में भाग नहीं ले सकती थीं। विशिष्ट आरोप और उनकी भूमिका के बावजूद अपराध, आरोप तय करने के चरण में ही महिला आरोपी व्यक्तियों को आरोप मुक्त करने के विशिष्ट कारणों के अभाव में, ट्रायल कोर्ट द्वारा की गई कोई भी धारणा कोई आधार नहीं रखती है, आरोपी व्यक्तियों को आरोप मुक्त करने का आदेश रद्द किया जाता है
