⭐SC: Discovery of weapon on information of accused – prosecution version believed.
Accused stating that the weapon of attack was thrown by him in a tank – Information supplied leading to the discovery of the weapon – Information given can be proved under S. 27, Evidence Act – The accused in the presence of the Investigating Officer while in custody offered to hand over the weapon attack which he said he had thrown into a tank, and thereafter he led the officer and witnesses to the tank and in the presence fetched the weapon from inside the tank. Held, this information is therefore provable and admissible.
