Hindu Marriage Act, Section 28 – Divorce by wife on the grounds of cruelty and desertion – alleging that husband not employed, borrowed all over the village and refused to heed the requirements of the appellant and children – Petition dismissed. In the appeal it’s held that the denial of love and affection and parental care itself will amount to cruelty. Respondent having denied the same to the petitioner, she had to live lonely and had grow the child in a fatherless atmosphere and thereby suffered mental agony and it will amount to cruelty – On these ground divorce granted and the – Appeal is allowed.
