The court upheld the finding of the Motor Accident Claims Tribunal that the driver of the car was guilty of rash and negligent driving as he hit the truck from behind, based on the testimony of an eye witness and the admission of the respondents &#8211; Quantum of Compensation &#8211; The court modified the amount of compensation awarded to the claimant from Rs. 2,23,34,350\/to Rs. 49,29,860\/-, based on the income tax returns of the deceased, the number of dependents, the multiplier applicable, and the heads of damages as per the Supreme Court precedents &#8211; The court rejected the contention of the insurance company that it was not liable to pay the compensation as the driver had a fake driving licence, as it failed to prove that the owner of the car was negligent in verifying the licence or that the policy was violated &#8211;
