State vs Netrapal CRLA 217\/17 09\/01\/24 [ AMIT JJ ] [ DELHI HIGH COURT ]\u2026"},"content":{"rendered":"\n<p><em>\u2022 PC ACT Sections 7 and 13(1)(d) The complainant, had filed a writ petition before the Delhi High Court in 2005 alleging that he had recorded videos of police personnel taking bribe from bootleggers The court directed the Commissioner of Police to conduct an enquiry, and a chargesheet was filed against the nine police officers in 2013 The prosecution relied on the video recordings as evidence, but the court found that the recordings were inadmissible as primary evidence because they were not original data and could have been tampered with The court also found that the recordings were inadmissible as secondary evidence because they were not accompanied by a certificate under Section 65B of the Evidence Act The court also found that the statement of the complainant was inadmissible as hearsay evidence &#8211; The complainant had stated that he had witnessed the police officers accepting bribe from the bootlegger, \u2018D\u2019 but \u2018D\u2019 himself did not testify that he had paid any bribe to the police officers &#8211; In addition, the court found that the prosecution had failed to establish that the police officers had demanded or accepted bribe &#8211; The court noted that &#8216;D&#8217; had stated that he had paid money to the police officers at the behest of his employer, \u2018J\u2019 and that he did not know why he was paying the money &#8211; The court also noted that \u2018J\u2019 was not examined as a witness &#8211; Based on the above findings, the court acquitted the nine police officers of all charges &#8211; The reasoning of the court is that the prosecution failed to prove its case beyond a reasonable doubt.
