\u2022 Constitution of India, 1950 Article 226 Absence from duty Departmental enquiry Petitioner, without waiting for sanction of his leave had proceeded on leave Charged for remaining absent from duty amounting to gross indiscipline, misconduct and dereliction of duty Held, an employee of any organisation is expected to follow the dignity and protocol and especially a member of the Force, is expected to be disciplined and acquiescent to the orders of the authority By not abiding the orders of the competent authority, the petitioner remained absent from duty which amounted to gross indiscipline, misconduct and dereliction of duty on his part Punishment awarded to petitioner held just and proper No interference warranted Present petition accordingly dismissed.
